These Terms and Conditions ("Terms") govern your use of the ScootAround website and your rental or purchase of any product from ScootAround, operating from Av. Gamonal, 9, 29630 Benalmádena, Málaga, Spain. By booking a rental, purchasing an item, or otherwise using this website, you agree to these Terms. 1. Who we are ScootAround provides mobility scooter, wheelchair, and walker rentals, sales, repairs, and parts, based in Benalmádena, Spain. - Email: scootaroundspain@gmail.com - Phone/WhatsApp: +34 655 717 967 - Address: Av. Eligibility to rent Mobility scooter rental is intended for individuals who are aged 50 or over, registered as disabled, or experiencing a genuine temporary mobility impairment (such as a broken leg or similar injury) that reasonably requires the use of a mobility scooter. By completing a booking, you confirm that you meet this criteria. We reserve the right to decline a rental if we reasonably believe it is not suitable or safe for the intended user. 3. Bookings and pricing - Rental pricing is shown on each product page: a flat rate covers the first 1–4 days, with a lower per-day rate applying to each additional day. Rentals of 4 weeks (28 days) or more are quoted individually — please contact us directly for these. - Prices, availability, and rental terms are as displayed on the website at the time of booking and are subject to change without notice for future bookings. - A booking is confirmed once you receive a confirmation from us, whether by online payment confirmation or, for walk-in bookings, directly in person at our shop. - We reserve a short period after each rental's return date to clean and safety-check the equipment before it becomes available again; this does not extend your rental period or affect your return date. 4. Payment - When booking online, payments are processed securely through Stripe. We do not store your card details. - For Delivery bookings, payment is required online at the time of booking. 5. Delivery and collection - Collection from our shop is free of charge. - Delivery is available for a fee based on distance, as shown at checkout; the delivery area and fees are set by us and may be updated from time to time. - You are responsible for being available to receive delivery or to collect equipment at the agreed time. Repeated missed deliveries/collections may incur an additional charge. 6. Sales items - Items purchased through our Sales catalogue are sold subject to your statutory consumer rights under Spanish and EU law, which are not affected by these Terms. - Please contact us directly regarding warranty, returns, or any issue with a purchased item. 7. Liability Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, our liability to you in connection with your use of our services is limited to the amount you paid for the relevant booking or purchase. 8. Intellectual property The ScootAround name, logo, and mascot, along with the website's design, text, and images, belong to ScootAround (or are used under licence) and may not be copied, reproduced, or used for commercial purposes without our prior written permission. 9. Privacy Our collection and use of your personal information, including the data needed to process a booking, is described in our [Privacy Policy]. By using this website, you also agree to our Privacy Policy. 10. Governing law and jurisdiction These Terms are governed by the laws of Spain. Any dispute arising from these Terms or your use of our services will be subject to the jurisdiction of the courts of Málaga, Spain, without prejudice to any mandatory consumer protection rights you may have to bring proceedings in your own place of residence within the EU. 11. Changes to these Terms We may update these Terms from time to time, for example if our services or policies change. The "last updated" date at the top of this page reflects the most recent revision.
